In this article you will learn about the Principle of Natural Justice in Political Science.
Principles of Natural Justice
Justice can be secured in society by adopting the following ways and principles :
Securing an absence of privileged classes and social discriminations in society
Justice means absence of social inequality, absence of special privileged classes in society and no discrimination against any person on grounds of caste, creed, colour, religion, place of birth, race and sex. Ensuring equality of all classes of people and gender equality is the basic principle of justice.
Protective Discrimination for securing Justice
Justice admits the principle of Protective Discrimination in favour of the weaker, disadvantaged and downtrodden sections of society (Dalits) with a view to empower them for becoming equal participating members of the society, economy and polity. It recognises the special needs of weaker sections of society and admits the grant of some special facilities and privileges (like reservations) to them for giving them adequate opportunities for rapid development. The aim of the principle of Protective Discrimination is to ensure equal opportunities for the participation of all sections of society in the process of all round development and progress.
Ensuring a system of Equal Treatment of Equals
Equal reward for equal work and equality of treatment for equally placed persons should be valued and respected. People should be judged and given different rewards not on the basis of caste, religion or class to which they belong but on the basis of their works and achievements. It includes the principle of proportionate justice which stands for the availability and grant of rewards in proportion to the quality and quantity of work. While basic minimum remuneration or rewards is given to each as it can enable him to meet his primary needs for food, shelter, clothing, shelter, education and health care, higher rewards are given to the people in proportion to the quality of their work, their abilities and responsibilities involved in the discharge of their functions in society.
Ensuring of Just Distribution in Society
Social Justice stands for a just and fair distribution of goods and services among the people of each society as well as among all nations of the world. The government of the state must take special steps for organising, maintaining and operationalising a system of just distribution of all goods and services, particularly all necessary goods and services. It must act for eliminating social and economic inequalities and try for ensuring that basic and qualitative life opportunities should be open for all the people without any discrimination.
Pursuit of Social Justice as the key objective
Social Justice means equal social rights and opportunities for the development of all the people. It essentially means absence of social discriminations and inequalities, as well as recognition of special needs of some people, fair distribution of goods and services and proportionate and just rewards for all.
