Safeguards of Liberty
Liberty is the most cherished right of every individual and the most valuable possession. Everyone wants to be sure that liberty is available to us in a proper and full measure and for this we need certain safeguards against every violation of liberty by other fellow, the society, the state and its government.
Let us discuss the following safeguards of liberty :
- People's Love for Liberty - The first and major safeguard of liberty is the ‘love for liberty’. Love for liberty tends people to have a passion for liberty and makes them realise the full measures and importance of liberty. Love for liberty ensures continuous attempts on the part of the people to enjoy their rights and defend their liberty.
- Vigilance of the people - The second most important safeguard of liberty is the commitment of the people to defend their liberty and alertness against any encroachment on their liberty. The people should be prepared to pursue freedom through every kind of danger and hardship.
- Equal Fundamental Rights for all - Another important safeguard of liberty is the equal fundamental rights given to all the citizens. Liberty exists only when equal rights are given and guaranteed to all classes of people without any discrimination. There should be no privileged class persons in society. Grants of special privileges are always against the spirit of liberty because it limits the freedom of others.
- Democratic Polity and Free Press and Media - Democratic polity with a well-knit party system is an essential safeguard of liberty. There can be no real democracy in the absence of the right to freedom. The presence of a liberal democratic political system with a well-organised and healthy party system, free press and media act as an essential safeguard of Liberty.
- Economic Justice - Economic Justice is essential for the safeguard of Liberty i.e. the rights of one should not be dependent upon others. It stands for the existence of a system with equitable and fair distribution of income and resources for all the sections of the society.
- Unbiased Government - It is essential that the government should exercise impartial and unbiased control over every section of society. The bureaucracy must remain neutral and act independently for equal and fair benefits of administrative laws and policies of the society.
- Constitutional and Legal Protection of Fundamental Rights - Constitutional and Legal Protection of fundamental rights is another key method of safeguarding liberty. An independent judiciary must be established and given the power to protect the rights and freedoms against any violation by any organ of the government or other organisation.
- Independence of Judiciary - Independence of the Judiciary is very important and it should be assigned the responsibility to protect all the rights of the people. Only an independent judiciary can protect the rights and liberty of the people. Separation of Powers - There should be separation of powers between the legislature, executive and the judiciary. Combination of these powers can be dangerous for the liberty of the people.
- Political Education and Enlightened Citizenship - It is essential that the citizens should be duly educated and enlightened. They must be fully aware and have knowledge about their rights and freedoms and enlightened enough to judge the dangers to their liberty.
